Terms & Conditions
Couples Getaways is a travel service offered by GIRLS GETAWAYS PTY LTD [ABN 55 653 558 260] (we, us, or our), on the terms and conditions set out below.
We provide a travel booking and advisory service which will allow you and your co-travellers (e.g. other couples) (you or your) to purchase travel products (e.g. transport, accommodation, dining and events) from third party suppliers individually or as part of a package of travel products (Getaway).
We act as agents for the third party suppliers of travel products, whose terms and conditions of supply (including cancellation and amendments policies) will apply to your travel request in addition to these terms and conditions.
BOOKING REQUESTS
By making a booking enquiry or request for a Getaway with us, either online or by email or phone, you agree that you have read, understood and accepted these terms and conditions.
Once you have made a booking enquiry or request with us, we will send to your nominated email address a booking request acknowledgement with details of your booking request (Booking Request Acknowledgment). You must immediately check our Booking Request Acknowledgment and inform us of any errors or amendments required.
At the time of making a booking enquiry or request, you must give us the names and email addresses of your co-travellers for your Getaway, each of who is then subject to these terms and conditions, as if they had lodged a booking enquiry or request with us themselves, noting in making the booking you are agreeing to act as their agent and be liable for the booking.
We will check the availability of travel products for your Getaway before taking your booking request but we do not warrant that your booking request is available. Your booking request is subject to availability at the time that we confirm your booking with the relevant third party supplier.
We will send you a confirmation of your booking request within a reasonable time of sending a Booking Request Acknowledgment (Booking Request Confirmation).
We do not make flight bookings but may give you recommendations of suitable airlines and flights based on our experience. However, any such recommendation cannot be relied upon and you must make your own enquiries as to the availability and suitability of airlines.
DEPOSITS AND BOOKINGS
Our Booking Request Confirmation will specify the deposit we require in order to confirm your booking with the relevant third party suppliers of travel products, and includes a non-refundable booking fee component. Note that any booking will attract cancellation fees and travel amendment rules will apply. Once the deposit is paid, we will confirm your booking with the relevant third party suppliers.
Once we receive confirmation from the third party supplier of their acceptance of the booking we have made for you, we will give you a booking confirmation or deposit receipt (Booking Confirmation), which will include particulars of the third party supplier’s terms and conditions (including cancellation and amendments policies) and a request for payment of the deposit.
CANCELLATION POLICY
Subject to the COVID-19 clause below, our standard cancellation policy is as follows:
A booking cancelled more than 6 weeks prior to departure - non-refundable $150pp booking fee is payable on cancellation;
A booking cancelled less than 6 weeks but more than 4 weeks prior to departure – 50% of the total cost of the travel products or package is payable on cancellation; and
A booking cancelled less than 4 weeks before departure – 100% of the total cost of the travel products or package is payable on cancellation.
Special cancellation conditions may also apply to particular tours and packages if stipulated by third party suppliers and may override the above conditions.
Where the third party supplier’s cancellation policy differs from our cancellation policy, we may choose, at our discretion, to charge you according to the third party supplier’s policy, instead of ours, subject to giving you notice in the Booking Confirmation.
No cancellation fee is payable for a cancellation made after a Booking Request Acknowledgement is issued but before a Booking Confirmation is issued.
COVID-19
Acknowledgement
Due to the ongoing Covid-19 pandemic, you acknowledge and agree that in using our services and during your Getaway:
you participate in the Getaway at your own risk;
we cannot guarantee that you will not become infected with the COVID-19 virus and you undertake the full risk of going on the Getaway under such circumstances; and
you understand that your risk of becoming exposed and/ or infected by the COVID-19 virus may result from the actions, omissions or negligence of yourself and others.
Cancellations and Postponements
These terms apply to cancellations for the whole group (part (a)) or individual members of a group (part (b)) as follows:
Part (a) Cancellations for the whole group
In the event, your whole Getaway group needs to be cancelled, amended or postponed due to travel restrictions or lockdowns imposed by your local government (Government Imposed Restrictions), we will refund the full amount less the per person deposit which will be kept and used towards a new booking (Rebooking Policy). This Rebooking Policy will only apply where we have received at least 48 hours notice before departure. Where you request to cancel, amend or postpone your Getaway with less than 48 hours’ notice, no refund will be provided and you are required to pay 100% of your Getaway package.
Your Rebooking must be done within 6 months of the date of cancellation, however, the date of your new getaway may be anytime within 2 years of your Rebooking.
Part (b) Cancellations for individual members of a group
Where only certain individual members of your group need to cancel, amend or postpone, then:
i. if the cancellations apply to less than half of your Getaway group, then the Rebooking Policy will apply to the specific individual members alone and we will alter your Getaway for the smaller group (subject to whether this can be arranged with our third party suppliers); or
ii. if the cancellations apply to half or more of the members of your Getaway group, then we will use our best endeavours to postpone or otherwise alter your Getaway as a whole. In the event that this is not possible for any reason, the Getaway will be cancelled for the whole group and the Rebooking Policy will apply to all members of the Getaway group.
c) We will use reasonable commercial endeavours to notify you of any cancellations, amendments or postponements of your Getaway through email, however, you acknowledge that it is your responsibility to ascertain whether your Getaway can still go ahead at the set time. Any refund issued to you under this clause will be your sole remedy for a postponement, amendment or cancellation of your Getaway due to Government Imposed Restrictions and we will have no further liability to you in respect of any cancellation or postponement of your Getaway for any reason.
d) For the avoidance of doubt, the above clauses (a)-(c) only applies to Government Imposed Restrictions do not apply to individuals who have been directed to quarantine, self-isolate, or wish to amend, postpone or cancel for their own COVID-19 related precautions. In this event, our standard cancellation policy applies.
e) You acknowledge that our cancellation policy in relation to COVID-19 is subject to change at any time in the event of new Government Imposed Restrictions or other requirements or conditions that are implemented due to the COVID-19 pandemic. We may also choose to apply a third party supplier’s cancellation policy to certain aspects of the Getaway where appropriate.
Waiver
During your Getaway, you may be required to comply with certain health and safety requirements of the places you are travelling to, including overseas countries (COVID Safe Protocols). Where required, you agree that you will use best endeavours to comply with any relevant COVID Safe Protocols, including where required by relevant government authority laws and regulations:
wearing a face covering or a mask;
maintaining any social distancing; and
any other requirements that may be implemented by the relevant government authorities.
You agree to release and hold us harmless from any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to you and/or property that may arise in any way in connection with:
any exposure and/ or infection of the COVID-19 virus at the Getaway organised by us; or
your breach of any COVID Safe Protocols while you are on your Getaway.
You understand that this release discharges us from any liability or claim that you may have against us with respect to any injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, the Getaway.
BOOKING AMENDMENTS
If you request an amendment to a booking request, after we have issued a Booking Confirmation, then we will use all reasonable endeavours to alter your booking as requested but do not warrant that we can do so. If we advise you that your amendment is not available then you may cancel your booking, subject to the cancellation and COVID-19 clauses above.
Bookings are non-transferrable.
PAYMENTS
Our Booking Confirmation will detail the amounts and required timings for your payment or payments for your booking. Your failure to pay strictly in accordance with those timings may result in a cancellation of your booking.
You and your co-travellers may pay us directly by credit card (Mastercard and Visa) or by Direct Deposit or by internet bank transfer.
TRAVEL DOCUMENTATION
Your itinerary, tickets, supplier confirmations and other travel documentation will usually be provided to you at least 72 hours before departure.
DISCLAIMERS
We will use all due care and skill in providing to you a booking and advisory service for your travel needs. However, subject to the Limitation of Liability clause below, we will not be responsible for or liable to you or your co-travellers for any of the following during or as a result of your Getaway:
Any injury or illness;
Any loss or damage to property;
Any cancellation or alteration to your booking made by a third party supplier;
Your displeasure with any aspect of your Getaway;
The omission of any aspect of your Getaway by a third party supplier;
Any component of your Getaway which you book or which is booked for you by someone else;
Your failure to obtain country visas or vaccinations, whether recommended by us or not;
Your passport having expired or having an insufficient remaining validity period;
The suitability of your flight bookings; and
Any changes to your itinerary during the Getaway which is outside of our control (including weather-related cancellations or postponements).
You indemnify us against any liability that we may have to third party suppliers as a result of any failure on your part to make a payment or for any damage or injury that you may cause during the course of your attendance at the premises or venue of the third party supplier.
MEDICAL ISSUES
You warrant that you do not have any pre-existing medical conditions or disabilities (Medical Issues) that will affect your ability to participate in the Getaway. If you have any Medical Issues, you should consult with a health professional as to whether the Getaway is appropriate for you prior to your booking. You are solely responsible for ensuring that you are medically capable of attending the Getaway. You acknowledge and agree that we are not responsible for and are not able to take any action for you if medical services are required while you are on your Getaway, including the attendance of any doctor, paramedics or ambulances, and that it is your responsibility to ensure your own health and safety.
Notwithstanding anything else in these Terms, we are not liable for any injury, death, damage or loss caused or due to any Medical Issues that occur during your Getaway.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not responsible for any loss, damage, expense or liability suffered by you or any other third party and caused or alleged to be caused directly or indirectly as a result of your Getaway booked through us.
Subject to the below, any condition or warranty which would otherwise be implied in these Terms are excluded. Our liability for breach of a guarantee conferred by the Australian Consumer Law is limited, in the case of services, to any one of the following as determined by us:
the supplying of the services again; or
the payment of the cost of having the services supplied again.
If there is a problem our services caused by a breach of these Terms by us (Omission), and you have notified us within 24 hours, then to the maximum extent permitted by law our liability arising from, or in connection with, the Omission will be limited to the face value of the booking purchased by you.
TRAVEL INSURANCE
To avoid you incurring a loss as a result of your travel, we have a strict policy that all of our clients (and their co-travellers) engaging in international travel must hold appropriate and adequate travel insurance. We also strongly recommend travel insurance for domestic travel. This can be insurance of your choice or we can refer you to a supplier of travel insurance or arrange travel insurance for you at your cost. We reserve the right to not accept a booking request or to not make a booking for international travel for any client who indicates that they will not take out travel insurance or who has failed to provide evidence of their travel insurance when requested by us.
AMENDMENTS TO THESE TERMS AND CONDITIONS
We may alter these terms and conditions at any time, subject to posting the revised terms and conditions on our website and/or notifying you by email or otherwise at least 72 hours before the alteration is made.

The Couples Getaways brand is a registered business name and registered trademark of Jennifer Anson and is protected by New South Wales and Australian laws.
